I understand that the program may include strenuous, physical activity and I am fully aware of the risks and hazards involved.

I understand that it is my responsibility to contact my physician prior to and regarding my participation in the program and facility. I represent and warrant that I am in good physical condition and have no medical condition that would prevent my participation in the programs and use of the Pink Lab Inc facility.

In consideration of being allowed to participate in the program and use of this facility, I do hereby waive, release, and forever discharge Pink Lab Inc. and their respected officers, agents, employees, and representatives from any and all claims, damages, demands, rights of actions, causes of actions, present or future, arising out of or connected with my participation in this or any exercise program, including any injuries resulting therefrom.

This waiver and release of liability includes, without limitation, injuries which may occur as a result of any a) malfunction or breakage of any equipment, b) any slip, fall, or dropping of equipment, c) and/or improper maintenance of equipment, d) and negligent instruction or supervision, or e) any other cause whether foreseeable or unforeseeable by the parties hereto.

I acknowledge that I have carefully read this waiver and release of liability and fully understand its' contents. I voluntarily and knowingly agree to the terms and conditions stated herein.

NEW PINKLAB COMBINED CONTRACT

1. New Pink Lab Policies

SERVICE AGREEMENT

This Service Agreement ("Agreement") is entered into as of the date of purchase between [Your Company Name] ("Company") and the individual or entity making the purchase ("Customer"). By making a purchase at The Pink Lab , the Customer acknowledges and agrees to the following terms and conditions:

1. Non-Refundable Purchases

All purchases made through The Pink Lab are final and non-refundable , with no exceptions . The Customer acknowledges that once a purchase is made, it cannot be refunded or returned for any reason, including but not limited to dissatisfaction, cancellations, or change of mind.

2. Initiation Fee and Prorated Amount

Upon purchase, the Customer agrees to pay the following fees:

• A non-refundable initiation fee of $50.00, which is due at the time of purchase.

• A prorated amount for the current billing cycle, calculated based on the number of days remaining in the month from the purchase date to the next billing cycle. This prorated amount is also due at the time of purchase.

3. Recurring Monthly Fee

The Customer agrees to a recurring monthly fee pertaining to the membership they selected (annual bronze, silver, or gold, or monthly bronze, silver, or gold), which will be automatically charged on the 1st day of each month for the duration of the service. The Customer acknowledges that this recurring monthly fee will continue until the service is canceled in accordance with the terms of this Agreement.

If the payment isn't made on time, there will be a $15.00 late fee charge.

4. Personal Training Packages

• All personal training packages are non-refundable after purchase, with no exceptions.

• The following training package options are available:

• Individual Session: $80.00 per session.

• Pack of 12 Sessions: $900.00.

• Pack of 24 Sessions: $1680.00.

• The Customer acknowledges and agrees that any personal training package purchased is non-refundable, and that they will not be entitled to a refund for any reason, including unused sessions.

5. Payment Authorization

The Customer authorizes the Company to charge their payment method for the following:

• The $50.00 initiation fee,

• The prorated amount for the current month,

• The $35.00 monthly recurring fee, and

• Any applicable fees for individual sessions or training packages (as described in Section 4 above).

The Customer agrees to maintain a valid payment method on file to cover all fees associated with this Agreement.

6. Changes to Terms

The Company reserves the right to modify or amend any terms of this Agreement, including pricing and fees, at any time. The Customer will be notified of such changes, and continued use of the services after notification will constitute acceptance of the revised terms.

7. Governing Law

This Agreement will be governed by and construed in accordance with the laws of [State/Country], without regard to its conflict of law principles.

8. No-Show or Late Arrival Fee

If the Customer signs up for a class and either:

• Fails to show up for the class, or

• Arrives more than 15 minutes late to the class, the Customer will incur a $15.00 charge. This fee will be automatically billed to the payment method on file.

9. Entire Agreement

This Agreement represents the complete and exclusive understanding between the parties and supersedes all prior agreements, representations, or understandings, whether written or oral, related to the subject matter of this Agreement.

Acknowledgment:

By making the purchase, the Customer acknowledges that they have read, understood, and agree to the terms and conditions set forth in this Agreement. The Customer further acknowledges that all purchases at The Pink Lab are final and non-refundable , and they are aware of the purchases they are making.

1. PINK LAB WAIVER AND POLICIES

PINK LAB MEMBER WAIVER AND AGREEMENT

By signing below, I {name} acknowledge that I have read, understood, and voluntarily agree to the terms and conditions outlined in this agreement. This waiver applies to all services and facilities offered by Pink Lab , including but not limited to in-person gym use, online coaching, personal training, and nutrition coaching.

LIABILITY WAIVER

I {name} understand and acknowledge that participation in any Pink Lab program, class, training session, or use of any equipment or facility is done at my own risk . I fully release and hold harmless Pink Lab, its owners, employees, trainers, staff, affiliates, landlords, and agents from any and all liability, claims, demands, injuries (including serious injury or death), damages, costs, or expenses arising out of or in connection with my participation or presence on the premises.

This includes, but is not limited to:

• Injuries caused by use of equipment, machinery, or gym structures
  
  

• Injuries sustained during classes, personal training, or online coaching
  
  

• Medical conditions, emergencies, or health complications
  
  

• Any results (or lack thereof) from nutrition coaching or fitness programming
  
  

I understand that I am solely responsible for my own safety, and I will seek professional medical advice before beginning any fitness or nutrition program.

CANCELLATION POLICY

All membership cancellations must be made in-person at the facility with a valid ID by the 10th of the month prior to cancellation.
For example, to cancel for July, you must cancel by June 10th . Cancellations after the 10th will result in being charged for the following month.

Day Pass

• $20 flat rate

• Must sign waiver

• Active for 24 hours from charge

Group Fitness Classes

• Drop-in class rate: $20 for members, $35 for non-members

Buddy Pass

Month-to-month Memberships vs. Annual Membership Options:

• Our 2026 membership options are available as either a month-to-month membership or a 12-month binding annual contract.

• Month-to-month memberships are billed on the 1st of each month in advance. Members can cancel at any time, following the same 10th of the month billing cycle policy.

• Annual memberships are also billed monthly, but at a discounted rate. By enrolling in an annual membership, members agree to a minimum 12-month commitment at the reduced price.

Bronze Membership

• $35/month grandfathered rate if signed up before January 1, 2026

Rescheduling & Missed Sessions:

Session Expiration:

• All personal training sessions expire after 6 months from date of purchase — no exceptions
  
  

NO REFUNDS POLICY

All sales are final . There are no refunds under any circumstances, including:

• Membership fees
  
  

• Class packages
  
  

• Personal training sessions
  
  

• Nutrition coaching or hybrid plans
  
  

Once purchased, you are fully committed to the duration and terms of the package.

ANNUAL FEES

A $70 annual maintenance fee will be charged on February 1st of each year to all members. This fee is non-refundable and applies to all membership tiers. By signing this agreement, you acknowledge and accept this recurring fee. 

• New Members: The annual maintenance fee will be charged two (2) months after the membership start date and annually thereafter .
• Existing Members: The annual maintenance fee will be charged on February 1st of each year .

I understand the terms of the annual fee.

RIGHT TO REFUSE SERVICE

Pink Lab reserves the right to refuse service to any individual at our sole discretion. This includes, but is not limited to, cases involving:

• Repeated cancellations or no-shows
  
  

• Inappropriate behavior toward staff or other members
  
  

• Violation of gym policies
  
  

DAMAGES & CONDUCT

Any member who causes damage to equipment, walls, mirrors, or any part of the facility , either through negligence or malicious behavior, is financially responsible for full repair or replacement costs.

Any behavior deemed as foul play, unsafe, aggressive, or disruptive may result in immediate termination of membership without refund and banning from all Pink Lab facilities .

By signing below, I agree that I cannot pursue legal action against Pink Lab for any reason related to my participation, membership, or incidents occurring on or related to the premises.

ACKNOWLEDGEMENT

I {name} confirm that I have read this waiver and agreement in full , understand all the terms, and voluntarily accept them by signing below. I understand that this agreement will remain in effect as long as I am a member or participant in any Pink Lab service or program.

Updated Pink Lab Policies Starting 11/30/2024

I {name} agree to the new conditions implemented to the Pink Lab Inc. starting on 11/30/2024 at 1:30pm.

I {name} understand that if in the future, I wish to cancel or make any changes regarding my membership at the Pink Lab, I must do so before the 10th at 10:30pm of the previous month that I wish to cancel or change. 

I {name} understand that all membership cancellations and changes will be required to be made in person at the facility. 

I {name} also understand that this is a shared community space and that Pink Lab Inc. has the right to refuse service if necessary.

I {name} understand that if a Personal Training package is purchased, I will have to complete bought package within 8 months of purchase excluding certain circumstances.

I {name} agree to the terms and conditions stated above and will honor and value said conditions.

Member Code of Conduct & Right to Refuse Service Agreement

Pink Lab is committed to providing a safe, respectful, and inclusive environment for all members, staff, and guests. By entering the facility and/or maintaining a membership, you agree to abide by the following standards of conduct.

Respectful Behavior Requirement

All members and guests must treat staff, trainers, and other members with respect at all times. Disrespectful behavior will not be tolerated.

Disrespectful behavior includes, but is not limited to:

• Verbal abuse, harassment, intimidation, or threatening language
  
  

• Discriminatory or derogatory remarks based on gender, race, religion, sexual orientation, body type, or appearance
  
  

• Sexual harassment, unwanted advances, or inappropriate comments
  
  

• Aggressive behavior, bullying, or hostile conduct
  
  

• Disruptive behavior that interferes with the safety, comfort, or experience of others
  
  

• Failure to follow staff instructions or gym policies
  
  

Zero-Tolerance Policy

Any behavior deemed disrespectful, unsafe, or inappropriate—at the sole discretion of gym management—may result in immediate corrective action.

Right to Refuse Service

The gym reserves the right to refuse service, deny entry, suspend, or terminate membership to any individual who violates this Code of Conduct, with or without prior warning .

Termination or refusal of service may occur:

• Immediately and without refund
  
  

• Temporarily or permanently
  
  

• Regardless of membership status or length of membership
  
  

No Refund Policy Upon Termination

If a membership is suspended or terminated due to violation of this agreement, no refunds will be issued for unused time, sessions, or services.

Acknowledgment

By signing below, you acknowledge that you have read, understood, and agree to comply with this Code of Conduct and understand that failure to do so may result in refusal of service or termination of membership.
